Just because you have been arrested for possession of marijuana, cocaine, methamphetamine, prescription medicines or other drugs, it does not mean that you will be convicted. Successfully defending your self from possession charges often requires detailed analyses and application of current law and the Fourth Amendment of the United States Constitution.

Unfortunately, local law enforcement rarely apply the law appropriately and often take an arrest all approach when dealing with possession cases. Also, fruitful yet illegal searches of citizens happen daily and go unchecked unless you have a knowledgable attorney who can help.

Possession cases vary in degree in penalty depending on the type and amount of drug as well as the location of possession and whether amounts/ circumstances were sufficient to enhance with intent to deliver allegations.

Even though drug possession is a “victimless” crime, penalties in Texas are stiff and can destroy careers and lives. Some dangerous, unseen consequences are:

  • Disqualification from government assistance such as student loans and housing.
  • Disqualification from obtaining a concealed weapons permit.
  • May not ship, transport or receive firearm ammunition.
  • Numerous legal issues with certain occupations.
  • Texas driver’s license suspension and/or yearly surcharges.
  • May not possess a firearm in certain circumstances

Some maximum penalties for “personal use” amounts

Marijuana (0-2 ounces) $2000 fine and 6 months in jail
Marijuana (0-2 ounces, school zone) $4000 fine and 1 year in jail
Prescription medicines (xanax, valium) $4000 fine and 1 year in jail
Cocaine (Less than 1 gram) $10,00 fine and 2 years in state jail
